HUD Expands FHA Financing Eligibility to Qualifying BTR Projects

The U.S. Department of Housing and Urban Development (HUD) recently announced a significant policy change that expands Federal Housing Administration (FHA) mortgage insurance eligibility to qualifying build-to-rent (BTR) communities. Effective immediately, professionally managed rental developments consisting of detached single-family homes, duplexes, and triplexes are eligible for FHA-insured financing under the same general framework as traditional multifamily properties.
BTR Communities’ Eligibility
Under the new guidance, eligible BTR developments may now qualify for:
- FHA Section 221(d)(4): New construction only
- FHA Section 223(f): Acquisition or refinancing of recently developed multifamily rental housing only, such as developments with a certificate of occupancy dated less than three years before an application
To qualify, communities must meet requirements that include:
- Operate as a single, cohesive rental property, consisting of at least five units
- Be professionally managed for long-term rental use
- A single tax parcel is preferable, although multiple contiguous parcels on a single site that defines the insured collateral is acceptable
- Projects with a mix of building types that include a BTR component along with traditional multifamily are acceptable
The Benefits for BTR Developers
Historically, HUD’s multifamily mortgage insurance programs were largely limited to properties with four or more units, excluding most BTR communities due to their single-family design and subdivision-style layouts. Under the new guidance, HUD recognizes the growth of professionally managed BTR developments and the increasing demand from renters seeking the space and lifestyle benefits of a single-family home without the barriers to homeownership.
The announcement creates a new government-backed financing option for a rapidly growing segment of the housing market that could make more projects feasible in a rapidly growing segment of the U.S. rental housing market.
Key benefits include:
- Lower cost of capital
- Higher leverage potential
- Long-term fixed-rate financing
- Reliable access to capital
BTR-specific Underwriting Considerations
HUD’s guidance also addresses several BTR-specific underwriting factors, including lease-up timelines, vacancy assumptions, replacement reserves, operating expenses, and sponsor experience. This approach helps ensure FHA financing is structured around the realities of operating a build-to-rent community, and the agency generally expects lenders to use conservative underwriting assumptions that reflect the unique operational characteristics of BTR communities.
